Things You Must Know About CAN-SPAM Act, READY?

Firstly, Have you ever wondered if your marketing emails are compliant with the CAN-SPAM Act? If they’re not, you could be subject to lawsuits, hefty fines, and even imprisonment.

You can’t break any rules if you’re using email to promote your business.

CAN-SPAM stands for “Controlling the Assault of Non-Solicited Pornography and Marketing” also known as the CAN-SPAM Act of 2003

This is setup to prevent Consumers from unsolicited email, bulk spam emails or commercial emails from brands and businesses.

Above all The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have you stop emailing them, and spells out tough penalties for violations.

Lastly, The U.S. Federal Trade Commission enforces the act, and CAN-SPAM also sets forth requirements for creating effective opt-out provisions for recipients that request to stop receiving emails or messages at any time.

Today we’re going to talk about the CAN-SPAM Act; we’ll cover who it applies to and what it entails. Don’t worry though, it’s not as long of a read as that name implies.

Keep Clean Header

Don’t keep any “From” or “To” Deceptive or Misleading Header

Subject Line Should Not Be Misleading

Do not make any false or misleading claims in the subject lines of your emails. Your subject line is what will make or break your email. False, misleading, or deceptive subject lines in an email, considered as violating the policy

It Is An Ad, ADMIT IT

You must disclose that your email is an ad. As per the CAN-SPAM Act, it is required that each business email sent says somewhere that it is an ad. 

For Example

Place (your business name here).”at the Bottom of your email as a text.

Never Miss Where You Are Located

Your message must include your valid physical postal address. You are setting yourself up for failure if your emails don’t come from a valid physical business address. Your physical business address needs to be in every email you send.  It is not possible to hide your identity.

Add your physical address in every email you send or it will be considered as a spam

MAKE-EASY Opt-Out 

The CAN-SPAM Act requires that every email or message sent must contain a way to unsubscribe from that email list. Also, if any recipient requests to unsubscribe, you must remove that subscriber from your commercial electronic messages list within 5 business days of sending the request.

Don’t Be Self-Satisfied

If you are using a third party to create and manage your business’s emails, it is ultimately your responsibility to ensure that the emails are compliant with the CAN-SPAM Act. Likewise, Before email release ask each email should be checked with all aspects of the CAN-SPAM Act,2003.

Honor Opt-out Requests

You must be able to process requests for at least 30 days after you send your message. You must honor this request within 10 business days. Lastly, Before you send your email, be sure you aren’t charging a fee or asking for any additional personal information, and that you do not sell their email addresses in the future.

Monitor What Others Are Doing

The law makes clear that you can’t contract away your legal responsibility to comply with the law, even if you hire another company to handle your email marketing.

The message sent by the company may be held as legally responsible. The company that promotes its product in the message is also responsible.
